Former President Donald J. Trump is set to launch a lawsuit against the Biden-Harris Department of Justice (DOJ), seeking a hefty $100 million in damages for the Federal Bureau of Investigation’s (FBI) 2022 raid on his Mar-a-Lago property.
The legal team representing Trump alleges that the raid was conducted with the aim of political persecution, characterizing it as “tortious conduct by the United States against President Trump.”
The genesis of this lawsuit can be traced back to the FBI’s raid on Mar-a-Lago on August 8, 2022, which was part of a wider federal investigation into Trump’s purported retention of classified documents.
A federal judge’s subsequent dismissal of Special Counsel Jack Smith’s case against Trump cited Smith’s unauthorized appointment and funding under the Constitution’s Appointments Clause.
Representing Trump, Attorney Daniel Epstein has formally notified the DOJ, allowing them 180 days to respond before proceeding with legal action in federal court in the Southern District of Florida.
Epstein contends that the raid involved intrusion upon seclusion, malicious prosecution, and abuse of process.
He argues that Attorney General Merrick Garland and FBI Director Christopher Wray failed to adhere to established protocols such as obtaining consent from the target and informing their legal representatives.
Epstein’s memorandum asserts that Garland and Wray’s actions were not rooted in valid social, economic, or political policies but rather were based on principles inconsistent with constitutional standards aimed at persecuting Trump.
The legal filing also specifies that the raid resulted in $15 million in damages for Trump due to incurred legal costs.
Trump’s attorney emphasizes that the FBI‘s actions violated his client’s privacy and were motivated by political factors. Subsequent court filings revealed that during the raid, the FBI had been authorized to use deadly force if necessary.
He argues that there was no constitutional basis for the search or any subsequent indictment, citing a Supreme Court ruling affirming significant immunity for presidents from prosecution pertaining to official acts.
