On July 30, 2024, United States District Judge Peter Sheridan declared New Jersey’s “assault weapons” ban to be unconstitutional, marking a significant legal victory for gun rights advocates.
The ruling was based on precedents set by two previous Supreme Court cases, Heller (2008) and Bruen (2022), which Judge Sheridan referenced in his decision.
In his ruling, Judge Sheridan specifically cited Heller and Bruen to assert that the AR-15 provision of New Jersey’s Assault Firearms Law violated the Second Amendment as it pertains to the use of the Colt AR-15 for self-defense within the home.
He emphasized that the precedent established in Bruen rendered any categorical ban on weapons commonly used for self-defense unconstitutional.
However, he allowed the “high capacity” magazine ban included in New Jersey’s assault weapons prohibition to remain in effect.
The decision prompted a response from New Jersey Attorney General Matt Platkin, an anti-gun Democrat, who announced plans to appeal Sheridan’s ruling on the AR-15 ban.
This legal battle reflects the deep divide over gun rights and regulations within New Jersey, which has consistently ranked as one of America’s most anti-gun states according to Guns & Ammo magazine’s rankings.
New Jersey’s status as an anti-gun state has led to a situation where pro-gun forces face significant challenges at the state level.
As a result, efforts to pass pro-gun measures have been greatly restricted, with nullification in red counties and municipalities serving as one of the few avenues for pushing back against stringent gun control laws.
Living in such a hyper-polarized state has created an environment where significant change in gun policy is difficult to achieve through traditional legislative means.
Instead, reliance on federal courts overturning gun control measures has become a key strategy for those seeking to reverse anti-gun encroachments in both the short and medium term.
Judge Sheridan’s ruling on New Jersey’s assault weapons ban represents a pivotal moment in the ongoing debate over gun rights and regulations within the state. It serves as both a legal victory for proponents of expanded gun rights and a catalyst for further legal battles between pro- and anti-gun forces.
This case highlights the broader challenges faced by those advocating for changes in gun policy within highly polarized states like New Jersey.
