Democrats Eye State-Level Gun Control Gains Amid Midterm Battles

Share X Facebook Email

As the 2026 midterm elections approach, gun control advocates are gearing up to advance a broad agenda of firearm restrictions at the state level, particularly in battleground states where Democrats have a chance to secure full control of government. While federal gun legislation faces a significant barrier with President Trump and the executive branch poised to block new laws, the focus has shifted to state legislatures where Democrats could enact sweeping changes if they achieve governing trifectas.

State Trifectas Could Unlock New Gun Restrictions

In states like Pennsylvania, Democrats are targeting key legislative seats to gain control of both the House and Senate. Currently, Democrats need to flip three seats to capture the state Senate and aim to expand their slim majority in the House. Success in these races could provide the votes necessary to pass major gun control measures.

The gun control lobby has outlined several priorities they hope to advance, including:

  • Expanded background checks: Democrats seek to broaden the scope of background checks required for firearm purchases. Although a bill passed the House last year, it has yet to receive a Senate vote.
  • Red flag laws: Legislation allowing courts to temporarily remove guns from individuals deemed a danger to themselves or others has been a focus. The House approved such a law in 2023, but the Senate did not follow. A similar measure was narrowly defeated in the House in 2025.
  • Ban on machine gun conversion devices: Proposals to outlaw devices that convert handguns to fire at extremely high rates nearly passed the House last year, falling short by a single vote.
  • Restrictions on ghost guns: Efforts to ban homemade, untraceable firearms have seen multiple attempts. A bill passed the House in 2024 but stalled in the Senate, and a 2025 attempt failed by one vote in the House.

Beyond Pennsylvania: Other States in Play

While Pennsylvania is a focal point, other states such as Minnesota, Wisconsin, and Arizona also present opportunities for Democrats to gain trifectas. Though gun control has not been a major campaign issue in many of these states, a Democratic takeover could quickly elevate it to a legislative priority.

In states where Democrats secure full control, additional measures could include permit-to-purchase requirements similar to those enacted in Colorado, new restrictions on National Firearms Act (NFA) items not currently regulated at the state level, and potential state-level taxation on certain firearms or accessories.

However, these states are far from guaranteed wins for Democrats. The outcome will heavily depend on voter turnout and engagement, particularly among gun owners and Second Amendment advocates.

The Role of Second Amendment Supporters in the Midterms

Recent elections have demonstrated the impact of voter complacency. The 2025 Virginia legislative session saw a Democratic majority pass over a dozen gun control laws after gun owners failed to mobilize effectively. This serves as a cautionary tale for supporters of gun rights in the upcoming midterms.

Gun owners and Second Amendment advocates could be the critical factor in preventing the passage of new restrictions by turning out to vote and staying engaged throughout the election cycle. Their participation may well be the firewall protecting the right to keep and bear arms in several key states.

Conclusion: Midterms Could Shape State Gun Laws for Years

With the federal government unlikely to enact new gun control laws due to executive opposition, the battleground has shifted to state legislatures. Democrats are preparing to push a comprehensive gun control agenda in states where they could secure trifectas, aiming to expand background checks, implement red flag laws, ban certain devices, and regulate ghost guns.

The stakes are high for Second Amendment supporters, who must remain vigilant and active to influence these critical races. The midterm elections will not only determine control of Congress but could also reshape the landscape of gun rights at the state level for years to come.
