This strong call follows the release of a report by special counsel Robert Hur, who thoroughly investigated Biden’s handling of classified documents during his time as a senator and vice president.
Despite Hur’s decision not to recommend charges against Biden, citing potential jury reluctance due to the president portraying himself as a sympathetic, elderly man with a poor memory, Tenney is emphasizing concerns about Biden’s health and mental acuity.
In a detailed letter addressed to Attorney General Merrick Garland, Republican Representative Claudia Tenney expresses her “grave concerns” about Biden’s capacity to discharge the powers and duties of his office, as outlined in the Hur report.
The 25th Amendment provides the White House cabinet with the authority to strip the president of power if he is deemed unfit for office. Tenney underscores the alarming aspects of the Special Counsel’s reasoning, highlighting instances of President Biden exhibiting compromised mental faculties and emphasizing the need for charges unless he is deemed mentally incompetent to stand trial.
Tenney contends that the report makes a compelling case for exploring proceedings under the 25th Amendment, stating that President Biden needs to be either charged or removed, leaving no middle ground in this matter. Democrats had proposed creating a commission to analyze a president’s mental fitness to execute the duties of the office, primarily in response to concerns about former President Donald Trump’s perceived mental instability. Former House Speaker Nancy Pelosi suggested the commission in October 2020, emphasizing the need for a process applicable to future presidents and underscoring the necessity of action based on the health of the current president.
Hur’s report, which raises substantial concerns about President Biden’s mental competence, particularly his difficulty in recalling significant dates, has prompted strong reactions among Republicans. Representative Marjorie Taylor Greene of Georgia joined Tenney in calling for invoking the 25th Amendment, asserting that the severity of Biden’s mental decline, as exposed in the Special Counsel’s report, renders him unfit for office. Greene emphasizes the urgency of either invoking the 25th Amendment or pursuing impeachment based on the report’s revelations.
